1. About Charleston Restroom Trailers LLC
Charleston Restroom Trailers LLC ("CRT," "we," "us," or "our") is based in Huger, South Carolina, and provides luxury restroom trailer rentals for events. We serve areas within a four-hour drive from Charleston, South Carolina.

2. Acceptance of Terms
By accessing our website, requesting a quote, or entering into a rental agreement with CRT, you ("Renter," "Customer," or "you") agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with these terms, please do not use our services.
3. Service Description
CRT provides luxury restroom trailer rentals for events, including:

Delivery and setup of restroom trailers

Removal of trailers after the rental period
-
Optional generator services (at additional cost)

Water supply via onboard fresh water tanks or connection to venue water supply
4. Rental Process
4.1 Quotes and Booking

Customers may request quotes through our website, phone, or email

Quotes are valid for 30 days unless otherwise specified
-
Bookings are confirmed upon receipt of full payment
4.2 Payment Terms
-
Full payment is required in advance of delivery
-
Customers may choose to pay in full at booking or in installments prior to the event date
-
Final payment must be received at least 48 hours before scheduled delivery
-
Accepted payment methods: Credit/Debit Cards, Online Payment (Wix), Check.
4.3 Non-Payment
If full payment is not received prior to the scheduled delivery date, CRT reserves the right to cancel the rental without liability. Any partial payments made may be subject to administrative fees.
5. Delivery and Pickup
5.1 Customer Responsibilities

Provide suitable access for delivery and pickup vehicles
-
Ensure a flat, stable parking area for the trailer

Confirm the trailer location is within 100 feet of electrical and water supply with appropriate hookups
-
Obtain any necessary permits or permissions from the venue
5.2 CRT Responsibilities
-
Deliver the trailer on or before the agreed rental start time
-
Remove the trailer after the rental end time
-
Provide basic operating instructions
5.3 Delivery Limitations
CRT is not responsible for failure to deliver or remove the trailer due to:
-
Insufficient access to the venue
-
Lack of suitable parking location
-
Restrictions imposed by the venue owner, operator, or manager
-
Acts of God, severe weather, or force majeure events
In such cases, the Renter remains obligated to pay the rental fee in full unless otherwise agreed in writing.
6. Use of Equipment
6.1 Proper Use
Renters agree to:

Use the trailer in accordance with provided instructions and applicable laws

Allow only CRT personnel to move or relocate the trailer
-
Prohibit smoking inside the trailer
-
Prevent vandalism, graffiti, or intentional damage
-
Not exceed the trailer's stated capacity
6.2 Prohibited Actions
Renters shall NOT:
-
Make physical alterations to the trailer
-
Attach decorations without prior written consent from CRT
-
Use the trailer for any illegal purposes
-
Sublet or transfer rental rights to third parties
7. Damage, Loss, and Theft
7.1 Renter Liability
The Renter is responsible for any and all damage to, loss of, or theft of the trailer from the time of delivery until CRT collects the equipment, regardless of fault. This includes damage caused by:

Improper use
-
Exceeding capacity
-
Vandalism or graffiti
-
Weather events
-
Third-party actions
7.2 Ordinary Wear and Tear
Normal, minor wear from appropriate use is expected and will not result in charges.
7.3 Reporting Requirements
Renters must immediately report to CRT any accident, theft, property damage, or injury involving the trailer.
8. Inspection and Acceptance
Upon delivery, the Renter shall inspect the trailer and immediately notify CRT of any defects or issues. Failure to report defects at delivery constitutes acceptance of the trailer in its delivered condition.
9. Title and Ownership
Title to all equipment remains solely and exclusively with CRT. Renters receive only the right to use the equipment during the rental period.
10. Indemnification
The Renter agrees to indemnify, defend, and hold harmless CRT and its affiliates, officers, members, employees, contractors, representatives, and agents from any and all liabilities, losses, damages, claims, injuries (including death), costs, and expenses (including attorney's fees) arising from:

Use, operation, or condition of the trailer

Breach of this agreement by Renter

Negligence or misconduct of Renter or their guests
-
Claims by third parties related to the rental
11. Warranties and Disclaimers
11.1 Inspection Period
Renters have the opportunity to inspect equipment upon delivery and must report any defects immediately.
11.2 Disclaimer of Warranties
CRT MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE TRAILER OR ITS CONTENTS AND SPECIFICALLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ANY WARRANTY ARISING BY USAGE OF TRADE, COURSE OF DEALING, OR COURSE OF PERFORMANCE.
11.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:

CRT shall not be liable for any consequential, special, punitive, exemplary, incidental, or indirect damages, including loss of profits, use, or time
-
CRT's total aggregate liability shall not exceed the total amount paid by Renter under the rental agreement
12. Force Majeure
CRT shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to:

Acts of God
-
Severe weather (hurricanes, flooding, tornadoes)
-
War or terrorism
-
Government orders or restrictions
-
Loss or theft of equipment
-
Significant damage to equipment by third parties
If a force majeure event prevents delivery, CRT may terminate the rental agreement without penalty and will refund all payments received.
13. Cancellation and Refund Policy

14. Governing Law and Dispute Resolution
14.1 Governing Law
This Agreement shall be governed by the laws of the State of South Carolina, without regard to conflict of law principles.
14.2 Jurisdiction and Venue
Any disputes arising from this Agreement shall be resolved exclusively in the State and Federal Courts located in Charleston, South Carolina. Both parties consent to the jurisdiction and venue of these courts.
14.3 Jury Trial Waiver
BOTH PARTIES HEREBY IRREVOCABLY AND UNCONDITIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY LITIGATION ARISING FROM THIS AGREEMENT.
15. General Provisions
15.1 Entire Agreement
These Terms of Service, together with the executed Rental Agreement and our Privacy Policy, constitute the entire agreement between the parties and supersede all prior communications and agreements.
15.2 Amendments
These terms may be amended only by written agreement signed by both parties. We may update these Terms of Service for future rentals by posting revised terms on our website with an updated "Last Updated" date.
15.3 Severability
If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full effect.
15.4 No Assignment
Renters may not assign, transfer, or sublet their rights or obligations under any rental agreement without CRT's prior written consent.
15.5 Waiver
Failure by CRT to enforce any provision shall not constitute a waiver of that provision or any other provision.
